This matter is taken up through Hybrid arrangement (video conferencing/physical mode). This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Khurda Sadar P.S. Case No.24 of 2022 corresponding to G.R. Case No.196 of 2022 pending in the court of learned S.D.J.M., Khurda for alleged commission of offences under sections 294/384/307/34 of the Indian Penal Code read with section 9-B of the Explosive Act, 1884.
Learned counsel for the petitioner submitted that the F.I.R. has been lodged by one Debaranjan Das in which the name of only one accused finds place i.e.
// 2 // Suvaranjan Samantaray. He further submitted that even though there is no accusation against the petitioner in the F.I.R. but the police is contemplating to arrest the petitioner in connection with this case and therefore, the anticipatory bail application of the petitioner may be favourably considered.
Learned counsel for the State opposed the prayer for bail.
In view of the available material on record, the nature and gravity of the accusation, while not inclining to grant anticipatory bail to the petitioner, I direct that in the event the petitioner surrenders before the learned Court below within a period of four weeks from today and moves for bail, the same shall be considered in accordance with law expeditiously by the learned Courts below. The case records shall be made available to the Courts concerned.
The ABLAPL stands disposed of.
Urgent certified copy of this order be granted on proper application.
