Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 21.01.2022 in connection with Bolangir Sadar P.S. Case No.36 of 2022 corresponding to G.R. Case No.05 of 2022 pending in the Court of learned Dist. & Sessions Judge, Bolangir for the alleged commission of offence under Sections 21(C)/29 of NDPS Act.

It is alleged that the petitioner was dealing with cough syrup and a total 5280 sealed bottles of Eskuf cough syrup were recovered from his possession. The quantity of codeine phosphate comes to 1.05 Kg which is marginally more than commercial quantity.

Considering the fact that the investigation has concluded and charge sheet has been submitted as also the period of detention in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and
proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.
