This matter is taken up through hybrid mode.

This writ petition has been filed for a direction for early disposal of RP Case No.9561 of 2001 pending before the Commissioner, Land Records and Settlement, Odisha, Cuttack. 3.

Mr. Behera, learned counsel for the Petitioner submits that the matter has not yet been considered and notice has not been issued to the opposite parties therein. He further submits that applications for substitution, condonation of delay in filing the substitution petition as well as setting aside abatement have also been filed. He, therefore, submits that a direction may be issued to the Commissioner, Land Records and Settlement, Odisha, Cuttack to take up the matter for issuance of notice to the opposite parties in the substitution matter. 4.

In that view of the matter, this writ petition is disposed of with a direction that in the event the Petitioner files a memorandum within a period of two weeks hence along with

// 2 // certified copy of this order before the Commissioner of Land Records and Settlement, Odisha, Cuttack for consideration of applications, as aforesaid, he shall do well to accept the same and make an endeavour for consideration of the aforesaid applications within a period of eight weeks from the date of filing such memorandum, if the matter is otherwise ready and there is no legal impediment.

Issue urgent certified copy of the order on proper application.
