Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 10.12.2021 in connection with Gunupur P.S. Case No.197 of 2021 corresponding to G.R. Case No.370 of 2021 pending in the Court of learned S.D.J.M., Gunupur for the alleged commission of offence under Sections 328/385/386/392/506 of IPC read with Sections 66(E)/67/67(A) of Information and Technology Act, 2000.

The allegation against the petitioner relates back to the year 2015 and it is further alleged that the petitioner, who had a relationship with the victim, blackmailed her into paying money from time to time in between 2016 to 2018. Further, the petitioner is also said to have taken nude photographs of the victim on the threat of making the same viral.

Learned Counsel for the petitioner submits that the allegations are false and baseless.

Learned State Counsel submits on instructions that no nude photographs of the victim have yet been found during

investigation.

Considering the above facts, the period of detention in custody and the fact that charge sheet has already been submitted in the case, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the Court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail. 8.

BLAPL is accordingly disposed of.
