This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Binika P.S. Case No.203 of 2021 corresponding to G.R. Case No.192 of 2021 pending in the court of learned J.M.F.C., Binika, Subarnapur for alleged commission of offences under section 394 of the Indian Penal Code and section 25 of the Arms Act.

In view of the available material on record and

// 2 // the nature and gravity of the accusation, while not inclining to grant anticipatory bail to the petitioner, it is observed that in the event the petitioner surrenders in the Court below within a period of four weeks from today and moves for bail, the same shall be disposed of as expeditiously as possible by the Courts below in accordance with law and if any co-accused has been released on bail in the meantime, the claim of parity shall be taken into account. The case diary be made available before the Court concerned for disposal of the case.

The ABLAPL is accordingly disposed of.
