IN THE HIGH COURT OF ORISSA AT CUTTACK

ABLAPL No.2088 of 2021 Choudhury Mohanta ....

Petitioner Mr. R.N. Rout, Advocate -versusState of Odisha ....

Opp. Party Mrs.Susamarani Sahoo, Addl. Standing Counsel

CORAM:

JUSTICE S.K. SAHOO Order No.

ORDER

25.11.2022 02.

This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 of Cr.P.C. in connection with Keonjar Sadar P.S. Case No. 130 of 2014 corresponding to Special Case No. 76 of 2014 pending in the Court of learned Special Judge, Keonjhar for offences punishable under sections 366/376/506/34 of the Indian Penal Code, section 4 of the POCSO Act and section 3 of the SC & ST (PoA) Act.

This case is of the year 2014 and the petitioner earlier approached this Court twice for grant of anticipatory bail in ABLAPL No. 3171 of 2015 and

// 2 // ABLAPL No. 13792 of 2017 and on both the occasions, the anticipatory bail applications were rejected and the petitioner was given liberty to surrender before the Court below and move for bail.

Learned counsel for the petitioner contended that the charge-sheet has not yet been submitted.

In view of the nature and gravity of accusation and when two earlier anticipatory bail applications have been rejected, I do not find any reason to reconsider this anticipatory bail application.

Accordingly, the prayer for grant of anticipatory bail stands rejected.

ABLAPL stands dismissed.
