Heard learned counsel for the Petitioner.

The Petitioner has neither a copy of the Plaint nor appears to have gone through the Plaint averment before filing the present C.M.P. It becomes difficult to proceed in the C.M.P. in absence of fundamental requirement. In the event the Plaintiff has still a case may pursue again but with required documents. Learned counsel for the Petitioner is permitted to withdraw the C.M.P. This Court also permits the Petitioner, if so advised, to come again but however with a copy of the Written Statement and Plaint. Certified copy of the impugned order be returned to the Petitioner after substituting the photocopy of the same.
