Heard learned counsel for the petitioner.

The petitioner has filed this writ petition seeking direction to the opposite parties to sanction 3rd RACP benefit w.e.f. 16.09.2013 in his favour with appropriate fixation of pay with grade pay of Rs.7600/- instead of Rs.6600/- by suitably modifying the order dated 18.11.2021 under Annexure-9 issued by opposite party no.1 and grant all consequential fixation of pay with arrear financial benefits. 4.

In course of hearing, learned counsel for the petitioner stated that highlighting the grievance, the petitioner has made representation to opposite party no.2 vide Annexure-13, which has been forwarded to opposite party no.1 vide Annexure-14 dated 21.01.2022. Therefore, direction may be issued to consider the same within a stipulated time. 5.

In view of the aforesaid limited grievance of the

petitioner, without expressing any opinion on the merits of the case, this Court disposes of the writ petition directing opposite party no.1 to take a decision on the representation filed by the petitioner under Annexure-13, which has been forwarded by opposite party no.2 vide Annexure-14 dated 21.01.2022 and pass appropriate order in accordance with law within a period of three months from the date of production of certified copy of this order.
