1. The Petitioner was 42 years old when the present petition was filed. Today, he is well over 48 years old. In view of Rule 9 (c) of the Orissa Superior Judicial Service and Orissa Judicial Service Rules, 2007 a person above 45 years cannot be appointed as a direct District Judge.

2. In that view of the matter, the petition has been rendered infructuous and it is disposed of as such.
