None appears for the petitioner at the time of call. 3.

The petitioner by this application U/S. 482 of Cr.P.C seeks to quash the order passed on 03.10.2016 by learned Sessions Judge, Bargarh in C.T. Case No. 120/28 of 2016 rejecting the prayer of the petitioner to discharge him from the case by framing the charge U/S. 452/302 of I.P.C. against the petitioner but no stay has been granted from further proceeding in this case and in the meantime, six years have already elapsed. This Court, therefore, entertains a reasonable doubt as to whether the cause of action for the petitioner still survives. 4.

In view of such development in the matter, the CRLMC is dismissed.
