1. This matter is taken up through hybrid mode. Order No.
2. Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.
3. The Petitioner is in custody since 17th January, 2022 in connection with Markatnagar P.S.
Case No.8/2022 corresponding to G.R. Case No.60/2022 pending in the court of learned S.D.J.M. (S), Cuttack, for the alleged commission of the offence under Sections 370/370-A(2)/34 of the I.P.C. and Sections 3,4,5 and 7 of the I.T.P. Act.

4. It is alleged that the Petitioner along with another person were managing a sex racket by procuring women from different areas. In course of raid, the Petitioner was found present in a room of the Hotel in which the immoral activity was going on in another room. Except the fact that he was allegedly present in the hotel, there is no other independent material to substantiate the allegation levelled against the Petitioner.
5. Having regard to the above facts and the period of detention in custody, I am inclined to allow the prayer for bail. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the court below on each date of posting of the case without fail.
6. The BLAPL is disposed of.
7. Urgent certified copy of this order be granted on proper application.
