Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody in connection with E.I. & E.B. Unit1, Cuttack P.R. No.195 of 2021-22 corresponding to Spl. G.R. Case No.150 of 2021 pending in the Court of learned Special Judge, Puri for the alleged commission of offence under Sections 21(C) of NDPS Act.

Considering the fact that the seized contraband is more than commercial quantity, being 325 grams of brown sugar, I am not inclined to allow the prayer for bail, which is therefore rejected. 5.

It is open to the petitioner to file an application for interim bail before the Court below. It goes without saying that if such application is filed, the same shall be considered.

BLAPL is accordingly rejected.

Issue urgent certified copy as per rules.
