Heard learned counsel appearing for the parties. Order No.

During course of hearing, learned counsel appearing for the petitioner wants to withdraw the writ petition to avail the remedy of appeal. In the event petitioner still situates over the land and the land is not required otherwise for the public purpose, while accommodating the petitioner for at least four weeks, the petitioner is permitted to file appeal within a period of seven days hence along with application for condonation of delay and also an application to protect his enjoyment of the disputed property at least till disposal of the appeal. 3.

In the event any such application for protection is filed, the same shall be considered and disposed of within a period of three weeks from the date of filing of the appeal.
