This matter is taken up through virtual/physical mode. 2.

The Petitioner had raised a grievance in respect of additional amounts of royalty erroneously paid for certain periods. The issue of refund was raised before this Court by filing W.P.(C) No.7761 of 2020, which was disposed of vide order dated 18th March, 2020 with the direction to the competent authority to pass a reasoned and speaking order on the claim.

At the time of hearing, Mr. L. Samanataray, Additional Government Advocate states that the Executive Engineer, Rural Works Division, Nimapara has issued a letter No.1313, dated 17th March, 2020 to the Tahasildar, Kakatpur for taking steps to refund the excess amount of royalty to the tune of Rs.2,27,517/-. He further states that the Tahasildar, Kakatpur would do the needful after obtaining approval from the higher

// 2 // authorities as per the guidelines issued by the State Government within next six months from today. 4.

In view of the aforesaid stand, Mr. Gourav Kumar Roy Choudhury, counsel appearing on behalf of Mrs. Kananbala Roy Choudhury, counsel for the Petitioner has no objection for disposing of the contempt petition in the light of the statement of the Additional Government Advocate.

Accordingly, this contempt petition is disposed of as infructuous. In case the needful is not done, the Petitioner would be free to get the present contempt petition revived by making a proper application.

Issue urgent certified copy as per rules.
