This matter is taken up through Hybrid Arrangement (Video Conferencing/Physical Mode). Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Kotagarh P.S. Case No.28 of 2011 corresponding to G.R. Case No.225(c) of 2011 pending in the Court of learned J.M.F.C., Kotagarh for alleged commission of offences under sections 120-B/121/ 121A/124A/364/302/506/34 of the Indian Penal Code read with sections 25 and 27 of the Arms Act and sections 15/16(1)(A)/18 of the UAP Act, 1967.

// 2 // In view of the available materials on record, the nature and gravity of the accusation and since the case is one under section 302 of the Indian Penal Code, while not inclining to grant anticipatory bail to the petitioner, I direct that in the event the petitioner surrenders and moves for bail before the learned Court below within a period of four weeks, the same shall be disposed of as expeditiously as possible in accordance with law by the Courts below. The case records shall be made available to the Court concerned.

The ABLAPL stands disposed of.
