Heard Mr. B.S. Tripathy, learned counsel for Petitioner. 3.

The petitioner has filed this writ petition seeking direction to the opposite parties to consider his case for rehabilitation appointment in any Class-IV post befitting to his qualification in terms of the OCS (RA) Rules, 1990 as amended in 2016 with a specific observation that the Rules, 2020 has got no application to the case of the petitioner.

Mr. B.S. Tripathy, learned counsel for the petitioner states that the application of the petitioner for compassionate appointment is pending before opposite party no.1 vide Annexure-10. Let direction be issued to opposite party no.1 to consider the case of the petitioner keeping in view the ratio decided by the apex Court in State of Madhya Pradesh V. Ashish Awasthi, 2021 (II) OLR (SC) 1072.

Considering the limited grievance of the petitioner, this Court, without expressing any opinion on the merits of the case, disposes of the writ petition directing opposite party no.1 to consider the application of the petitioner vide Annexure-10 and pass appropriate order in accordance with law keeping in view the ratio decided by the apex Court in Ashish Awasthi (supra) within a period of three months from the date of production of certified copy of this order.

With the aforesaid observation and direction the writ petition stands disposed of.
