Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 05.01.2022 in connection with Kinjirkela P.S. Case No. 42 of 2021 corresponding to G.R. Case No. 677 of 2021 pending in the court of learned S.D.J.M., Sundargarh for the alleged commission of offence under Section 302 of IPC.

Considering the severity of allegations and the existence of materials prima facie in support thereof, I am not inclined to allow the prayer for bail, which is therefore, rejected. It is open to the petitioner to renew his prayer after examination of Bishal Toppo
during trial.

The BLAPL is accordingly rejected.
