This matter is taken up through hybrid mode.

The Petitioner being in custody in C.T. Case No.37 of 2019, arising out of Padwa P.S. No.14 of 2019, pending in the Court of Additional Sessions Judge, Koraput, has filed this petition for his release on bail. The offence alleged against him is punishable under Section 302 read with Section 34 of the I.P.C.

Heard the learned counsel for the Petitioner and the learned counsel for the State-Opposite Party. 4.

Considering the facts and submissions made, especially the fact that the most of the material witnesses have already

// 2 // been examined and co-accused, namely, Basudev Kirsani has already been released on bail in the meanwhile and also the Petitioner has hardly any chance of absconding, this Court directs that the Petitioner be released on bail in the aforesaid case by the Court in seisin over the matter on such terms and conditions as it would deem just and proper.

Accordingly, the BLAPL stands disposed of being allowed.
