This matter is taken up through hybrid mode.

2. Heard Mr. S.G. Das, learned counsel for the petitioner.

3. The petitioner has filed this writ petition seeking direction to the opposite parties to allow the Grade Pay of Rs.5,400/- towards 2nd RACP and Rs.6,600/- towards 3rd RACP with effect from 01.01.2013 under RACP Scheme with disbursement of differential salary of the petitioner forthwith.

4. Learned counsel for the petitioner contended that the petitioner had earlier approached the Odisha Administrative Tribunal by filing O.A. No.896 of 2019, which has been disposed of on 28.03.2019 with a direction to opposite parties to grant the Grade Pay of Rs.5400/- and Rs.6600/- as 2nd and 3rd RACP with effect from 01.01.2013 in favour of the petitioner and also make pay fixation as per rules within a period of one months from the date of receipt of the order. non-compliance thereof, the petitioner

approached this Court by filing W.P.(C) No.6603 of 2020, which has been disposed of vide order dated 24.02.2020. In compliance of the said order, Annexure-4 dated 04.08.2020 has been issued stating that the Principal Secretary, PR & DW Department is not a party in the said case.

In that view of the matter, this Court disposes of the writ petition directing opposite party no.4 to consider the case of the petitioner for grant of RACP in terms of the direction giving by the Odisha Administrative Tribunal in O.A. No. 896 of 2019 and this Court in W.P.(C) No.6603 of 2020 as expeditiously as possible preferably within a period of three months from the date of production/ communication of certified copy of this order.

Issue urgent certified copy as per rules.
