This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard the learned counsel for the petitioners and learned counsel for the State.

This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioners in connection with Mahulpada P.S. Case No.35 of 2021 corresponding to G.R. Case No. 464 of 2021 pending in the Court of learned S.D.J.M., Bonai for commission of alleged offences under sections 341, 147, 148, 353, 354, 186, 294, 506, 323/149 of the Indian Penal Code.

Since it is a case where attack has been made to the public servants on duty, while not inclining to release the petitioners on anticipatory bail, it is observed that in the event the petitioners surrender and move for bail in the Court below within a period of four weeks from today, the same shall be disposed of in accordance with law expeditiously by the learned Courts below and the claim of parity with the coaccused, who is stated to have been released on bail including the proviso to section 437(1) of Cr.P.C. for petitioner nos.1 and 2, shall be taken into account. The case records shall be made available to the Courts concerned for disposal of the bail application. The ABLAPL stands disposed of.
