It is stated by the learned counsel for Petitioner that pursuant to the notice of eviction vide Annexure-3 the Petitioner has already appeared in the proceeding, but however, on 18.02.2022 the Petitioner filed an application thereby requesting for granting three months' time. It is also alleged that such request of the Petitioner is also pending before the Deputy Commission, Sambalpur Municipality.

Considering the submission made by the learned counsel for Petitioner, this Court directs, if the Petitioner has already applied for three months' time to vacate the disputed premises in question, let a consideration be made to such application of the Petitioner by giving

// 2 // personal hearing to him and also keeping in view that the Petitioner is in occupation of the said land by using it as a residential purpose in the meantime. It is also directed that the Petitioner may be provided with reasonable time to vacate the disputed premises. It is further directed that till a decision is taken in the matter, there shall be no eviction / demolition involving the Petitioner from the disputed land in question.
