This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as learned counsel for the State.

Limited grievance of the Petitioner in the present writ petition is that promotion of the Petitioner to the post of Senior Revenue Assistant from Junior Assistant has not been considered by the Collector-cum-District Magistrate, Nayagarh-Opposite Party No.2 and seeking for a direction to consider the representation of the Petitioner under Annexure-3.

It is submitted by learned counsel for the Petitioner that although the Petitioner has filed a representation before the Collector-cum-District Magistrate, Nayagarh-Opposite Party No.2, the same is still pending before him and the said Opposite Party has not taken any decision on the representation of the Petitioner as of now. He further submits that in view of the circular issued vide Office Memorandum dated 17th June, 2021, the Petitioner is eligible
// 2 // to get the promotion in respect of the said circular. 5.
Mr. K.K. Nayak, learned counsel for the State submits that he has no objection, if a direction is given to the Opposite Parties to consider the representation of the Petitioner within a stipulated period of time.

Having heard learned counsel for the parties, this Court disposes of the writ petition with a direction to the Collector-cumDistrict Magistrate, Nayagarh-Opposite Party No.2 to consider the representation of the Petitioner under Annexure-3 in the light of Government Circular dated 17th June, 2021 under Annexure-1 within a period of eight weeks from the date of production of certified copy of this order in accordance with law. It is needless to mention here that the representation of the Petitioner shall be considered by a speaking and reasoned order on the same. Any decision taken on the same shall be communicated to the Petitioner within a period of ten days thereafter.

With the aforesaid direction, the writ petition stands disposed of.

Urgent certified copy of this order be granted on proper application.
