Learned counsel for the Petitioner states that, the wife of the Petitioner has deserted the Petitioner, taking away his minor child with her and she is stated to be staying in her father's place now with the child.

There is also pending cases between the parties for matrimonial disputes.
4.
In the fitness of things, the Petitioner may move the appropriate Court for claiming guardianship of the child instead of invoking the jurisdiction of this Court under Section 226 of the Constitution of India.

With the aforesaid observation, the WPCRL is disposed of. ........................
