Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is in custody since 03.01. 2022 in connection with Itamati P.S. Case No. 2 of 2022 corresponding to G.R. Case No. 1 of 2022 pending in the court of learned Sessions Judgecum-Special Judge, Nayagarh for the alleged commission of offence under Sections 20(b)(ii) (C) of NDPS Act. 4.

It is alleged that the petitioner and four other persons were transporting contraband ganja weighing 58 kgs. 600 grams when they were apprehended by police.

Learned State Counsel submits that the petitioner is a habitual offender and that after being released in connection with 2 (a)CC No. 16 of 2022 in the file of learned Sessions Judge-cumSpecial Judge, Cuttack, he committed the present offence.

Considering the conduct of the petitioner, I am not inclined to allow the prayer for bail, which is therefore rejected. 7.

The BLAPL is accordingly rejected.
