ORDER

13.12.2022 Hybrid Mode 5.

1. The petitioner is a borrower having taken gold loan amounting to Rs.3,00,562/- from the opposite party nos.2 and 3-IIFL Finance Limited.

2. By filing the writ petition, the petitioner has prayed for a direction to the opposite parties to waive the amount demanded Rs.41.196/- as overdue for closing the account.

3. None appears for the petitioner when the matter is called. None had appeared when the matter was last listed on 15.09.2022 and the matter was adjourned granting another opportunity to the petitioner.

By order dated 08.03.2022 this Court had observed as follows :

"2. A mercy pleas has been raised for grant of some time to deposit the required amount for renewal of the gold loan account, whose maturity already has expired.

xx xx

5. As an interim measure, subject to the petitioner depositing a sum of Rs.15,000/- (by either means) with the IIFL Finance Limited on or before 15th March,2022, the successful bid, if any in the auction of the pledged gold fixed for 15th February, 2022 shall not be confirmed without the leave of the Court."

4. Despite matter having been listed subsequently on 22.03.2022, 04.07.2022 and lastly on 15.09.2022 the petitioner has not deposited the amount of Rs.15,000/- as directed by this Court in the conditional order dated 08.03.2022.
