Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in T.R. Case No. 133 of 2020 arising out of Orkel P.S. Case No. 183 of 2020 on the file of learned Sessions Judge-cum-Special Judge, Malkangiri for the alleged commission of offence under Section 20(b)(ii)(C) of the NDPS Act.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Sessions Judge-cum-Special Judge, Malkangiri by order dated 2.11.2020, in the aforementioned case, the present BLAPL has been filed. 5.

Taking into account the order passed by this Court dated 6.08.2021 in BLAPL No. 3634 of 2021 relating to co-accused, it

is directed that the Petitioner shall be released on bail. The terms and conditions shall be fixed by the court in seisin over the matter, so as to ensure the presence of the petitioner on each date of trial. 6.

Accordingly, the BLAPL stands disposed of.
