This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.
This is an application under section 438, Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Orkel P.S. Case No.251 of 2021 corresponding to G.R. Case No.1128 of 2021 pending in the Court of learned J.M.F.C., K.Gumma for alleged commission of offences under sections 294, 323, 325, 341, 307, 506/34 of the Indian Penal Code read with section 25 of the Arms Act, 1959.
Considering the submissions made by the learned counsel for the State that the sole injured Krushna Bag has sustained simple injuries and the
// 2 // submission of the learned counsel for the petitioner that the ingredients of the offence under section 307 of the Indian Penal Code are not attracted and the fact that the petitioner has been granted interim protection since 22.03.2022 and there is no material that he has misutilized his liberty, the interim order dated 22.03.2022 is made absolute.
The ABLAPL is accordingly disposed of.
