Banti @ Soumya Ranjan Swain v. State Of Odisha
IN THE HIGH COURT OF ORISSA AT CUTTACK
BLAPL No. 1689 of 2022 Banti @ Soumya Ranjan Swain ....
Petitioner Ms. D. Mohapatra, Advocate - Versus - State of Odisha ....
Opposite Party Mr. S.K. Mishra, Addl. Standing Counsel
CORAM:
JUSTICE SASHIKANTA MISHRA
ORDER
23.03.2022 Order No.
1.
This matter is taken up through hybrid mode.
2.
2.
Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.
3.
The petitioner is in custody since 08.02.2022 in connection with Patkura P.S. Case No.51 of 2022 corresponding to G.R. Case No.239 of 2022 pending in the Court of learned S.D.J.M., Kendrapara for the alleged commission of offence under Sections 341/294/323/307/427/379/506/34 of IPC.
4.
It appears that the FIR does not refer to any weapon being used. However, the injured victim has stated about being assaulted by means of knife and iron rod etc. Be that as it may, as many as five co-accused persons, who stand more or less on the some footing as the petitioner, have already been released on bail by order of this Court passed in ABLAPL No. 1950 of 2022. 5.
Having regard to the above facts, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of
the case without fail.
6.
BLAPL is accordingly disposed of.
7.
Issue urgent certified copy as per rules.
