This matter is taken up through Hybrid Mode.

Heard Mr. A.R. Panda, learned counsel for the petitioner and Miss S. Mishra, learned Additional Standing Counsel for the State.

The petitioner is aggrieved by the order dated 29.09.2018 and post Charge-sheet order dtd. 06.09.2021 by which NBWA was issued. Ex-facie this Court does not find any infirmity in the orders dtd. 19.01.2019 or 06.09.2021 passed by the learned J.M.F.C.(R), Balasore in Criminal Trial No. 01 of 2018 directing issuance of NBWA.

Learned counsel for the petitioner states that though he was all along available for express his reasons, the Investigating Agency have shown him as an absconder.

Be that as it may, this Court directs that in the event the petitioner surrenders within a period of three weeks hence and moved for bail, the learned Court in seisin of the matter shall consider the same on its own merits.

6.

For a period of three weeks, no coercive action shall be taken against the petitioner.

7.

The CRLMC is disposed of accordingly.
