2. 1. This matter is taken up through hybrid mode.

2. The writ petition has been filed by the petitioner, claiming to be a well-wisher of Upendra Nath Degree College, Soro, Balasore challenging notification dated 06.01.2022 (Annexure-2), issued by the Govt.

Department of Higher Education proposing the name of O.P. No.5 to be nominated as President of the Governing Body of the college.

3. Apart from other averments, it has been alleged that the communication dated 06.01.2022 is contrary to Rule 25 of the Odisha Education (Establishment, Recognition and Management of Private Colleges) Rules, 1991. It is further submitted that the petitioner has made series of representations as at Anexure-3 series.

3. It is submitted by learned Addl. Standing Counsel that the petitioner does not have any locus standi to raise any grievance regarding the affairs of Degree

// 2 // College controlled by the Government, in accordance with Rules.

4. It is submitted by learned counsel for the petitioner that the petitioner may be allowed to withdraw the writ petition to pursue the appropriate remedy/authority for redressal of his grievance.

4. Accordingly, the writ petition is disposed of as withdrawn granting liberty as prayed for.
