This matter is taken up through virtual/physical mode. 2.

The Petitioner-Company is the defaulting borrower in multiple (3) loans availed from the Bank of Baroda, Main Branch, Cuttack, against whom recovery process under the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 has been initiated. 3.

The instant writ petition has been filed challenging the E-auction sale notice dated 4th February, 2022 fixing the auction sale of the secured assets on 14th March, 2022 for liquidating the outstanding liability of around Rs.6 crores 30 lakhs as on today.

At the time of hearing, memo of withdrawal has been filed seeking permission to withdraw the writ petition to enable the Petitioner to pursue its remedy already filed SA No.8 of 2022 before the DRT, Cuttack.

Accordingly, this writ petition is dismissed as withdrawn with the aforesaid liberty.
