This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the Petitioner as well as the learned counsel appearing for the State.

The Petitioner has filed this Writ Petition seeking a direction to the Opposite Party No.3 to sanction/fixation of pay in existing promotional pay band and Grade Pay in pay matrix level-10 Cell-1 attached to the promotional post as per MACP entitlement to the post of Assistant Fisheries Officer towards 2nd RACP on completion of 20 years of continuous service with effect from 01.01.2013 as per Finance Department Resolution No.3560 dated 06.02.2013. 4.

It is submitted by the learned counsel for the Petitioner that the Petitioner has filed representation before the Director of Fisheries, Odisha, Opposite Party No.3 on 23.12.2021 under Annexure-8, but

// 2 // the said Opposite Party No.3 has not considered the representations of the Petitioner as of now.

Learned counsel appearing for the State submits that he has no objection if a direction is given to the Opposite Party No.3 to consider the representation of the Petitioner within a stipulated period of time.

Considering the limited nature of grievance of the Petitioner, this Court disposes of the writ petition with a direction to the Director of Fisheries, Odisha, Opposite Party No.3 to consider the representation of the Petitioner dated 23.12.2021 under Annexure-8 in the light of the order passed by the learned Tribunal under Annexure-4 within a period of two months from the date of production of certified copy of this order. It is open for the Petitioner to file a copy of the judgment he is relying upon before the authority along with certified copy of the order as well as representation. It is needless to mention here that the representation of the Petitioner shall be considered by passing a speaking and reasoned order on the same. Any decision taken on the same shall be communicated to the Petitioner within a period of two weeks thereafter.
