Despite publication of notice through Newspaper, nobody is appearing on behalf of the contesting Opposite Parties. However, considering the grounds stated in this I.A., delay in filing the restoration petition stands condoned subject to the Petitioners' depositing a sum of Rs.300/- (rupees three hundred only) in favour of the "Orissa High Court Bar Association Welfare Fund" by Monday (18th April, 2022).

The I.A. stands disposed of.

Looking to the averments made in this petition and keeping in view the inconvenience faced by the learned counsel for Petitioner

// 2 // in placing the case bearing F.A. No.440 of 1990 on 31.07.2019, this Court directs, subject to the Petitioners' filing a receipt showing payment of cost in time, the CMAPL will be treated to have been allowed by restoring the F.A. No.440 of 1990 to its file. 2.

F.A. No.440 of 1990 will also be listed before the appropriate Bench, but after obtaining necessary consent of the Hon'ble Court.

CMAPL is disposed of with above direction.
