Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 07.01.2022 in connection with Nandankanan P.S. Case No.1 of 2022 corresponding to T.R. Case No.5 of 2022 pending in the court of learned District and Sessions Judge, Bhubaneswar for the alleged commission of offence under Sections 20(b)(ii)(C) & 29 of NDPS Act. 4.

The prosecution allegation is that the petitioner was escorting his Maruti Car in which three persons were travelling and from which the contraband ganja was found. There appears to be a time gap between the apprehension of the petitioner and the car in which the contraband was being transported. The petitioner was implicated allegedly on the basis of the confessional statement. There is no other material to show his

involvement in the alleged occurrence.

In such view of the matter, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.

BLAPL is accordingly disposed of.
