This matter is taken up through Hybrid Arrangement (Video Conferencing/Physical Mode). Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 of Cr.P.C. for grant of anticipatory bail to the petitioner in connection with C.D.A. Phase II P.S. Case No.23 of 2014 corresponding to G.R. Case No.891 of 2014 pending in the court of learned S.D.J.M. (Sadar), Cuttack for alleged commission of offence under section 380 of the Indian Penal Code.

It is a case of the year 2014, in which charge sheet stated to have been submitted against the petitioner basing on the confessional statement of co-

// 2 // accused and the said co-accused has already been released on bail.

In view of the available material on record, while not inclining to grant anticipatory bail to the petitioner, it is observed that in the event the petitioner surrenders in the Courts below within a period of four weeks from today and moves for bail, the same shall be disposed of as expeditiously as possible by the Courts below in accordance with law and if any co-accused has been released on bail in the meantime, the claim of parity shall be taken into account. The case records be made available before the Courts concerned for adjudication of the bail application. The ABLAPL stands disposed of.
