Heard learned counsel appearing for the petitioner. Order No.

Considering the submission of Mr.Nayak, learned counsel for the petitioner and going through the observation made in the impugned order, this Court finds there has been technical reason of objection in a miscellaneous petition. For the observation of the competent court, this Court though declines to interfere on the issue at this stage but, however, observes such contingency if raised in the trial of the suit on the revival of the trial, the same will be heard and considered in the ultimate trial of the suit.

With this observation, the Civil Miscellaneous Petition stands disposed of.
