Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 09.02.2022 in connection with Khurda P.S. Case No.313 of 1995 corresponding to S.T. Case No.14 of 2022 pending in the Court of learned 2nd Addl. Sessions Judge, Khurda for the alleged commission of offence under Sections 395/333/307 of IPC.

It is submitted that more than 42 to 50 persons came in a group and assaulted the forest officials, in course of which some of the officers and staff sustained injuries. It is further submitted that the principal accused, namely, Dinabandhu Biswal has since been acquitted for want of any evidence.

Having regard to the submissions as above, the materials on record, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the

trial Court on each date of posting of the case and even on a single default necessary orders shall be passed by the Court below to take him to custody again.

BLAPL is accordingly disposed of.
