The Special Court Act being a Self-contempt Act and there being a forum for the appeal under Section 17 of the Act, we are not inclined to admit this CRLMP on the sole ground that question of constitutionality is involved, in as much as such question can also be gone into in the appeal and, if required, the Appellate Court being the High Court, can also exercise its plenary power under Article 226 of the Constitution of India.

The CRLMP is accordingly disposed of with the aforesaid observation.

A free copy of this order be supplied to the learned Standing Counsel for the Vigilance Department.
