This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard Mr. Asok Mohanty, learned senior counsel for the petitioner and Mr. P.C. Das, learned Additional Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the petitioner for anticipatory bail.

The petitioner is seeking pre-arrest bail in connection with C.T. Case No.1111 of 2022, arising out of Capital P.S. Case No.112 of 2022 pending in the court of learned S.D.J.M., Bhubaneswar (T) CSI, Bhubaneswar for commission of offence punishable under Sections 454/380/411/34, I.P.C.

It is submitted by Mr. Asok Mohanty, learned senior counsel for the petitioner that pursuant to the direction of this Court vide order dated 16.03.2022, the petitioner had been appearing before the

// 2 // Investigating Officer on the date fixed and the same has been confirmed by learned counsel for the State. It is further submitted by learned counsel for the petitioner that the stolen articles have already been recovered in the meantime and that further custodial interrogation is not necessary in the present case. 6.

Considering the nature of allegation, gravity of offence and the fact of the case, I am not inclined to grant anticipatory bail to the petitioner. However, it is directed that in the event the petitioner surrenders and moves for bail before the learned court in seisin over the matter within a period of three weeks from today in the aforesaid case, he shall be released on bail on such terms and conditions as would be deemed just and proper with further conditions that petitioner shall cooperate with the Investigating Officer as and when required for the purpose of investigation with prior notice of the Investigating Officer and further he shall appear before the trial court on each date of posting through his lawyer.

Violation of any of the terms and conditions shall entail cancellation of bail.

Accordingly, the ABLAPL is disposed of.

Urgent certified copy of this order be granted on proper application.
