ORDER

23.06.2022 I.A. No. 687 of 2022 This matter is taken up through Hybrid arrangement (video conferencing/physical mode).

This is an application for modification of the order dated 22.03.2022 and also for extension of time to surrender as well as to consider the claim of parity.

Learned counsel for the petitioners submitted that in the operative portion of the order dated 22.03.2022, it has been mentioned that in case the bail application of the petitioners is rejected by the learned J.M.F.C., Parjang, the

// 2 // petitioners can move an application for bail in the Court of Session at Dhenkanal. He submits that the Court name may be corrected as 'Additional Sessions Judge, Kamakhyanagar' in place of 'Court of Session at Dhenkanal' and the date of surrender be extended. Learned counsel further submitted that one of the co-accused has already been released on bail and therefore, direction may be given to the learned Courts below to consider the claim of parity.

Learned counsel for the State has no serious objection.

Considering the averments made in the interim application, in the operative portion of the order dated 22.03.2022, the words 'Court of Session at Dhenkanal' be read as 'Additional Sessions Judge, Kamakhyanagar' and the date of surrender is extended till 11th July 2022. While disposing of the bail application, the claim of parity shall be taken into account.

With the aforesaid modification, the rest part of the order dated 22.03.2022 remains unaltered.

I.A. is accordingly disposed of.

Issue urgent certified copy as per Rules.
