This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

None appears for the petitioner at the time of call, so also no one had appeared on behalf of the petitioner on the last date. Further, the petitioner by way of an application U/S. 482 of Cr.P.C. has sought for to set aside the order passed on 21.02.2015 by learned Additional Sessions Judge, Jharsuguda in S.T. Case No.28 of 2014 and permit him to adduce his evidence on behalf of his prosecution. In the meantime seven years have already elapsed after filing of this CRLMC and the same is pending before this Court. It, therefore, appears as to whether the cause of action for the petitioner still survives in this case and whether the case has not been disposed of in the meantime. 3.

In view of the aforesaid, especially when none had appeared today and on the last date to move the CRLMC, it seems that the petitioner is not interested to prosecute the matter. 4.

Hence, the CRLMC is dismissed for non-prosecution. ( G. Satapathy) Judge Subhasmita
