This matter is taken up through hybrid mode.

This contempt petition has been filed against the Opposite Party No.1-Collector & District Magistrate, Khurda for noncompliance of order dated 21st January, 2022 passed by this Court in W.P.(C) No.1897 of 2022.

But, as it appears, vide order dated 9th March, 2022, the Opposite Party No.1-the Collector, Khurda has passed an order directing on payment of penalty imposed, the vehicle be released. So also F.I.R. in this case appears to have been lodged. 4.

It is the contention of the learned counsel for the Petitioner that no F.I.R. was lodged and the vehicle of the Petitioner illegally

// 2 // detained, which is contrary to the order of the Opposite Party No.1Collector, Khurda. 5.

Be that as it may, since the Opposite Party No.1-Collector, Khurda has already passed an order, there appears to be no defiance of this Court's order, I am not inclined to issue notice to the Opposite Party No.1-Collector, Khurda. As such, the same stands dropped. 6.

However, it is open to the Petitioner to take recourse to remedy for release of the vehicle in question by filing an appropriate petition before the appropriate forum in accordance with the provision provided under Section 51 of the Orissa Minor Minerals Concession Rules and in that event, the same shall be considered and disposed of within a period of fifteen days of filing of such petition. 7.

With the aforesaid order, this contempt petition stands closed. (S. Pujahari) Judge DA
