CORAM:
JUSTICE BISWANATH RATH
ORDER
03.03.2022 1.
1.
Heard learned counsel appearing for the parties. Order No.
2.
Petitioner being aggrieved by Annexure-3, being an order of eviction has come to approach this Court. From the fact, it appears, petitioner has already faced O.P.L.E. proceeding in the year 2006. Not only there has been order of eviction but on accepting verdict of the competent authority finding the petitioner to be an encroacher, petitioner appears to have already deposited the fine amount. At this stage of the matter, learned counsel appearing for the petitioner prays for withdrawal of the writ petition with liberty to the petitioner to file objection to the competent authority.
This Court allowing withdrawal of the writ petition, permits the petitioner, in the event there is no action pursuant to Annexure-3 as on date, to file her objection within a period of ten days hence, as undertaken, along with certified copy of this order, in such event the Sambalpur Municipal Corporation shall do well in taking a decision on the objection of the petitioner vis-à-vis notice at Annexrue3 by completing entire exercise within a period of one month thereafter but, however, involving the petitioner.
// 2 // disputed property as on date shall be maintained by both parties till such period.
