1. This matter is taken up through virtual mode. Order No.

2. Heard Mr. P.S.Mohanty, learned counsel for the Petitioner and Mr. P. Tripathy, learned Addl. Standing Counsel for the State.

3. The petitioner is in custody since 24th January, 2022 in connection with Kamarda P.S.

Case No.115/2021 corresponding to C.T. Case No.20/2021 pending in the court of learned G.N.-cum-J.M.F.C., Bhograi for the alleged commission of the offence under Sections 294/506/363/376/109/34 of I.P.C.

It is submitted that there is no specific allegation against the present Petitioner save and except the fact that keeping father of the boy, who is said to have kidnapped the victim had arranged the care. It is also submitted that the wife of the Petitioner against whom similar allegations were made had already been released on bail as per order passed by this Court in ABLAPL No.2160/2022

5. Considering the submissions made, the materials on record and the fact that similarly situated co-accused has already been released on bail, I am inclined to allow the prayer for bail. Let the Petitioner be released on bail on such terms and conditions as may be imposed by the court in seisin over the matter in the aforesaid case including the condition that he shall appear before the trial court on each date of posting of the case without fail.

6. The BLAPL is disposed of.

7. Urgent certified copy of this order be granted on proper application.
