Mr. Bhutia, learned advocate appears on behalf of petitioner and submits, the bank is raising purported grounds in not extending credit facility to his client to run Atta Chaki. First the bank said that his client was running tailoring shop. Now the bank is saying the business will not be viable.

Mr. Kar, learned advocate appears on behalf of the bank and submits, due diligence done by the bank revealed that in event loan is granted, likelihood of recovery is not there.

In view of submissions aforesaid, Court cannot interfere and compel the bank to extend credit facility against its due diligence on recovery prospects.
