1.The present petition under Section 11 (6) of the Arbitration and Conciliation Act, 1996 ('Act') seeks the appointment of an Arbitrator to adjudicate the dispute between the Petitioner and the Opposite Party, arising out of the Agreement under Annexure-1.

2. Having heard learned counsel for the parties and having perused the agreement in question and the pleadings in the present petition, the Court is of the view that the issues regarding limitation as well as merits of the claim of the Petitioner can well be examined by the learned arbitration in accordance with law.

3. The Court accordingly appoints Mr. Surya Prasad Mishra, Senior Advocate as the sole Arbitrator to adjudicate the disputes between the parties including the claims and counter claims if any.

The arbitration shall take place under the aegis of the High Court of Orissa Arbitration and Mediation Centre.

4. The arbitration petition is disposed of accordingly. A copy of this order be communicated to the learned Arbitrator forthwith.

5. An urgent certified copy of this order be issued as per rules. (Dr. S. Muralidhar) Chief Justice M. Panda
