It is a successive bail application filed by the petitioner, his earlier application has been rejected by this Court vide order dated 25.07.2017 passed in BLAPL No. 4664 of 2017.

It is submitted by Mr. Sahoo, learned counsel for the petitioner that in the meantime trial having commenced, four witnesses including the informant and the eye-witnesss have been examined but they have not supported the case of the prosecution. Copies of the depositions of witnesses have been enclosed to the bail application. It is true that the informant, who was examined as P.W.-2 and the eye-witness, who was examined as P.W.-1, have not supported the case of the prosecution, fact remains that there are further witnesses to be examined in the case. In such view of the matter, this Court is not inclined to allow the prayer for bail. However, considering the fact that the case is of the year 2016 and trial has already commenced it is directed that the learned trial Court shall do well to try and dispose of the case as early as possible, preferably within a period of two months from today. It shall be open to the petitioner to renew his prayer for bail, if trial is not concluded within the aforesaid period.

BLAPL is accordingly rejected.
