1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. Pursuant to the order passed by this Court on 21.11.2022 Office note indicates that no fresh counsel has been engaged by the Opp. Party in the meantime.

3. Heard Mr. P.K. Ray, learned counsel for the Petitioner.

4. This transfer petition has been filed seeking transfer of C.P. No. 09 of 2019 from the Court of learned Judge, Family Court, Kendrapara to the Court of learned Judge, Family Court, Cuttack.

5. It is contended that the Petitioner is prosecuting a matter under the provision of D.V. Act before the learned J.M.F.C., Cuttack. It is also contended that the Petitioner is residing with her parents within the jurisdiction of learned Judge, Family Court, Cuttack and she is not in a position to appear before the learned Judge, Family Court at Kendrapara.

6. Having heard learned counsel for the Petitioner and taking into account the grounds taken and the decisions governing the field, this Court is inclined to allow the prayer. Accordingly, this Court directs learned Judge, Family Court, Kendrapara to transfer C.P. No. 09 of 2019 pending before him to the Court of learned Judge, Family Court, Cuttack forthwith on receipt of this order.

7. The transfer petition is disposed of.
