Heard Mr.B.N.Satapathy, learned counsel for the petitioner and Mr. Zafrulla, learned Additional Standing Counsel.

According to Mr.Satapathy the petitioner is aggrieved by non-registration of F.I.R. i.e. Nikirei P.S. Case No. 11 dated 25.1.2022 under the appropriate provisions of law. He submits that the F.I.R. should also have been registered for commission of offence under Section 307 I.P.C. in the facts and circumstances of the case. He further submits that though highlighting all his grievances, the petitioner has approached the Superintendent of Police, Kendrapara (opposite party No.2) by filing a grievance petition dated 11.2.2022 vide Annexure-2 however, till date no action has been taken on the same. In such background, he prays that necessary directions be issued to opposite party No.2 to take a decision on the said grievance petition within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs the Superintendent of Police, Kendrapara (opposite party No.2) to take a decision on the grievance petition dated 11.2.2022 of the petitioner under Annexure-2 in accordance with law within a period of four weeks from the date of receipt of a certified copy of this order, if in the meantime, the same has not been disposed of and communicate the result of such exercise to the petitioner. While presenting a certified copy of this order, the petitioner is directed to supply a copy of the grievance petition under Annexure-2 to opposite party No.2. 5.
Accordingly, this CRLMP is disposed of.
