This matter is taken up through hybrid mode.

The Petitioner's vehicle bearing Registration No. OD16-B-9307 (Truck) is the subject matter of the present writ petition.

Learned counsel for the Petitioner submits that the Petitioner shall pay the amount of tax and he shall file show cause under Section 13(2) of the Orissa Motor Vehicle Taxation Act, 1975 so far as penalty is concerned and so far as the offence is concerned, he shall file an application under Section 200 of the Odisha Motor Vehicles Act, 1988 for compounding. 4.

Taking into consideration the submission advanced, this writ petition is disposed of directing the Petitioner to pay the tax levied on him before the R.T.O.-cum-Taxing Officer, Sundargarh-Opposite Party within three weeks from today and so far as the penalty is concerned, the Petitioner shall file show cause under Section 13(2) of the Orissa Motor Vehicle Taxation Act, 1975 within the aforesaid period and so far as the offence is concerned, he shall file an application for compounding under Section 200 of the Motor Vehicles Act within the aforesaid

// 2 // period. On payment of tax and on compounding of the offence, if accepted, the vehicle bearing Registration No. OD-16-B-9307 (Truck) shall be released in favour of the Petitioner. 5.

The writ petition is accordingly disposed of. Urgent certified copy of this order be granted on proper application.
